Moisture and caking can create serious problems in grain shipments.
But the presence of moisture upon arrival does not automatically establish carrier liability.
The investigation should consider:
- Moisture level at loading.
- Moisture level at arrival.
- Condition of the grain when loaded.
- Condition of the container or vessel holds.
- Voyage conditions.
- Water ingress or condensation.
- Ventilation and storage conditions.
The key question is: did the damage occur during carriage, or did it exist before loading?
Survey reports, samples, laboratory results, and loading and discharge records may therefore become critical evidence.
