Incorrect ACI Data: Who Bears the Risk?

Prepared by the Maritime & Admiralty Team at Soliman Advocates

This article has been prepared by the firm's maritime lawyers as part of Soliman Advocates' Maritime Legal Insights series, drawing on the team's experience in Egyptian maritime law and shipping disputes.

Under the ACI system, an error in cargo data or electronic documentation may create an issue that goes beyond simply correcting the information.

Several parties may be involved in providing cargo information, including the importer, exporter, shipper, freight forwarder, carrier or shipping agent, depending on the document and procedure concerned.

Liability may become disputed where an error or discrepancy results in shipping delays, delayed cargo release or additional costs.

Responsibility should not automatically be attributed to one party simply because the issue appeared within the Nafeza system. The source of the information, the party responsible for providing or verifying it, and the relationship between the disputed data, shipping documents and underlying contracts should be examined.

Determining responsibility may be critical when dealing with claims for delay, additional expenses or losses affecting the cargo or vessel.
