Can a Vessel Be Arrested in the Suez Canal?

In principle, a vessel may be arrested while navigating the Suez Canal where a maritime claim arises from an incident or damage occurring during her passage through the Canal, provided that the applicable legal requirements for arrest are satisfied.

Examples may include claims arising from collision, pollution, damage to buoys or navigational aids, or incidents involving tugs or pilotage vessels.

Pollution incidents may give rise to claims for economic and property damage suffered by coastal facilities, tourist and residential communities, fishermen, fishing vessels, fish farms and other affected parties.

In such circumstances, the competent court may be approached to seek the arrest of the vessel, subject to the applicable legal requirements.

The mere passage of a vessel through the Suez Canal, without an underlying maritime claim or incident giving rise to a valid basis for arrest, does not in itself constitute grounds for detaining or arresting the vessel.
