Grain Cargo Disputes: When Laboratory Results Differ from Shipping Documents

In shipments of wheat, corn, soybeans and other food-grade bulk commodities, disputes may arise when laboratory or inspection results differ from the specifications or information stated in the cargo documents.

The consequences may extend beyond acceptance or rejection of the cargo and may result in delayed customs clearance, continued detention or financial claims between the parties involved.

The issue becomes particularly significant where laboratory results affect customs or regulatory requirements, cargo classification or eligibility for release.

In such cases, relying on a single test result may not be sufficient. The sampling procedure, testing authority, agreed specifications, cargo documents and other relevant technical findings should be examined.

It is equally important to determine how the issue affects the shipowner, charterer, shipper, receiver and importer, in light of the applicable contractual obligations and shipping documents.
